USTAWA O SPRAWIEDLIWYM ZABEZPIECZENIU SPOŁECZNYM 

Do Kongresu USA została zgłoszona Ustawa “H.R. 82, 118 Congress – Social Security Fairness Act of 2023” mająca wyeliminować “Government Pension Offset (GPO)” i “Windfall Elimination Provision (WEP)” z obecnej Ustawy o Social Security (Social Security Act). Propozycja ta ma poparcie wielu Kongresmenów i Senatorów. Gdyby ta Ustawa została uchwalona i podpisana przez Prezydenta, wtedy potrącenie WEP przestałoby obowiązywać. Obecnie powoduje ono redukcję emerytury i renty inwalidzkiej Social Security dla tych, którzy również mają emeryturę albo rentę inwalidzką wypracowaną poza systemem Social Security (np. świadczenia z polskiego ZUS albo KRUS).

  1. Sprawdź, kto jest twoim Reprezentantem w Kongresie. W tym celu udaj się do: house.gov/representatives/find-your-representative i wstaw swój numer kodu pocztowego.
  2. Sprawdź, kto jest twoim Senatorem. W witrynie senate.gov/senators/senators-contact.htm wybierz nazwę swego stanu.
  3. Wydrukuj listy do swojego Reprezentanta i do dwóch Senatorów (wzory poniżej).
  4. Wpisz swoje dane osobowe, datę i złóż swój podpis.
  5. Adresując list i kopertę użyj adresy polityków z powyższych linków.
  6. Zachęć swoich krewnych i przyjaciół, by zrobili to samo.

As your constituent, I urge you to support the Social Security Fairness Act (H.R. 82) to repeal the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO)

WEP unfairly cuts Social Security retirement and disability benefits (up to $557.50 a month in 2023) for workers who also have retirement or disability benefits from sources not covered by Social Security. WEP affects many government workers and legal immigrants who did not manage to accumulate 30 years of covered employment with “substantial” earnings.

WEP disproportionally affects hard working, low-income immigrants for the following reasons:

  • WEP reduction is disproportionally greater for low-income workers than for high earners.
  • Immigrants seldom have a chance to achieve 30 years of employment covered by the Social Security system, required for WEP elimination.
  • Immigrants’ income is usually lower, not reaching the required level of “substantial earnings”, so even if they work in the US for 30 years, they are still punished by the WEP.

Furthermore, the Social Security Administration deceives the public with the so called “WEP Guarantee”. In the Windfall Elimination Provision booklet (https://www.ssa.gov/pubs/EN-05-10045.pdf) the SSA pledges: “The law protects you if you get a low pension. We won’t reduce your Social Security benefit by more than half of your pension on which you didn’t pay Social Security taxes”. It is not true for the following reasons:

  • The longer a worker postpones his retirement, the higher the WEP reduction becomes, up to 60-70% for those working till the age of 70 (depending on COLA). The WEP reduction is capped at 50% only for those who retire early at 62, but immigrants usually work longer to maximize their benefits.
  • Married couples are double punished as worker’s WEP reduction causes decrease of associated spouse’s benefits.
  • WEP is not recalculated or lifted even if a retiree continues work but does not reach 30 years of substantial earnings. Also, WEP is never recalculated to account for currency fluctuation.

For the above listed reasons, the Windfall Elimination Provision is discriminatory and very unfair. High earners can avoid it, but not low earners. In addition, the SSA misleads the public about the WEP consequences. Immigrants affected by WEP are taken by surprise, shocked by low retirement benefits on which they cannot survive.  For these reasons, I urge you to pass the Social Security Fairness Act, so the immigrants and public employees could receive the benefits for which they worked so hard.
